Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and NEXAI TECH ("ThumbLoop", "we", "us", or "our"), which operates the website loop-tube.com and the ThumbLoop service (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What ThumbLoop does

ThumbLoop is an AI tool that turns a short video idea into YouTube thumbnail images, title suggestions, and SEO tags, with a built-in headline editor. Images and text are produced by third-party AI models. Outputs are generated automatically and may vary in quality, accuracy, and style. We do not guarantee any specific result, click-through rate, view count, ranking, or business outcome.

2. Eligibility & accounts

• You must be at least 18 years old, or use the Service under the supervision of a parent or legal guardian who accepts these Terms.
• We use passwordless sign-in: we email a 6-digit one-time code to verify your address. You are responsible for keeping access to your email account secure and for all activity under your account.
• You agree to provide an accurate email address so we can deliver credits, receipts, and support.

3. Credits, pricing & payments

• The Service is sold as prepaid credits. One standard credit produces a set of thumbnails plus titles and tags, as described at checkout. Premium actions (for example, Clone Style) may cost more credits, shown before you confirm.
• Prices are shown on our pricing section and may be displayed in INR or USD based on your location. Applicable taxes, if any, are your responsibility unless stated otherwise.
• Payments are processed by Razorpay. We do not store your full card or UPI details. Creating an order does not charge you; you are charged only when you complete payment.
• Credits are added to your balance instantly after a successful payment. Credits never expire, have no cash value, and are non-transferable.
• Generations that fail due to a technical error on our side do not consume credits. Refunds are handled under our Refund & Cancellation Policy.

4. Free trial & watermark

New users may receive a limited free generation so you can try the real output. Free outputs carry a small ThumbLoop watermark and may be subject to daily limits. Purchasing credits removes the watermark and unlocks more generations.

5. Acceptable use

You agree not to use the Service to:

• create content that is illegal, defamatory, hateful, harassing, sexually explicit involving minors, or that promotes violence or self-harm;
• impersonate any person or brand, or create content that is deceptive, fraudulent, or misleading;
• infringe anyone's copyright, trademark, publicity, privacy, or other rights, including generating exact copies of protected logos, characters, or photographs;
• attempt to extract, reverse-engineer, or reproduce a third party's proprietary assets, or to bypass safety, rate, or credit limits;
• submit prompts designed to manipulate, jailbreak, or overload the underlying AI systems, or to disrupt the Service for others.

We may suspend or terminate access, and remove content, if we reasonably believe these Terms have been violated.

6. Your content & intellectual property

• You own the thumbnails you create. Subject to your payment and these Terms, you may use your generated and edited thumbnails for personal and commercial purposes, including on YouTube.
• You grant us a limited, non-exclusive licence to store and display your creations in your private gallery, and—only if you explicitly use the "Share a public link" feature—to host that specific image at a public URL you can revoke by contacting us.
• The ThumbLoop name, logo, website design, and software are our property and may not be copied or used without permission.
• You are responsible for ensuring your final use of any output complies with applicable law and the rights of third parties, as well as YouTube's and other platforms' policies.

7. Clone Style policy

"Clone Style" reads the publicly available thumbnails of a YouTube video, playlist, or channel you provide and produces a high-level description of its visual style (such as composition, colour, contrast, and framing). It then generates brand-new, original thumbnails for your own video in a similar mood. Clone Style is designed not to copy logos, faces, exact assets, text, or copyrighted characters from the source.

Style and general ideas are not protected by copyright, but specific expression can be. You agree to use Clone Style responsibly and to not use it to imitate another creator in a way that is deceptive or that infringes their trademarks, likeness, or other rights. You are solely responsible for how you use the resulting images.

8. AI disclaimer

AI outputs are provided "as is". They may contain inaccuracies, repeated elements, or unintended similarities to existing works, and may not be unique to you. You are responsible for reviewing every output before publishing it. We are not liable for decisions you make based on AI output.

9. Availability & changes

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may add, change, suspend, or discontinue features (including pricing, credit values, and AI providers) at any time. Where changes materially affect prepaid credits you have already bought, we will act reasonably and in good faith.

10. Limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for credits in the three (3) months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify and hold NEXAI TECH harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or third-party rights.

12. Governing law

These Terms are governed by the laws of India. Subject to applicable law, the courts at our place of business in India will have exclusive jurisdiction over any dispute relating to the Service.

13. Updates to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest version. Continued use of the Service after changes means you accept the revised Terms.
